1. About these disclaimers
These Disclaimers apply to tekemsolutions.com (the “Website”) and, to the extent not addressed in a separate signed agreement (an “Agreement”), to services provided by Tekem Solutions Inc. (“Tekem,” “we,” “us” or “our”). They form part of our Terms of Service. If an Agreement conflicts with these Disclaimers, the Agreement controls.
2. Website provided “as is”
The Website and all content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Website will be uninterrupted, timely, secure or error-free, that content is complete or current, or that the Website is free of viruses or other harmful components. You use the Website at your own risk.
3. No professional advice
Content on the Website, including service descriptions, articles, FAQs and job listings, is general information only. It is not legal, tax, accounting, financial, immigration, employment-law or cybersecurity compliance advice, and it is not a substitute for advice tailored to your situation. Using the Website or contacting us does not create a consulting, advisory or other professional relationship. A professional relationship begins only when an Agreement is signed, and our advice is then limited to the scope of that Agreement. Consult qualified professionals before acting on any information.
4. Limitation of liability
To the fullest extent permitted by law, Tekem and its officers, employees, consultants and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of or related to the Website or our services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims related to (a) the Website is limited to one hundred US dollars ($100), and (b) our services is limited to the fees you paid to Tekem for the specific services giving rise to the claim during the twelve (12) months before the event that caused the claim, unless your Agreement sets a different limit.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Disclaimers limits liability that cannot be limited by law, such as liability for fraud, gross negligence or willful misconduct.
5. Indemnification
You agree to defend, indemnify and hold harmless Tekem and its officers, employees, consultants and agents from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Website; (b) your breach of our Terms of Service or these Disclaimers; (c) information, files or content you submit to us, including inaccurate application or project information; (d) your systems, data or instructions; or (e) your violation of any law or the rights of any third party.
6. Concealed and pre-existing system conditions
Technology engagements often reveal conditions that were not visible or disclosed when the work was scoped. These can include undocumented code or integrations, legacy systems, data quality problems, security vulnerabilities, misconfigurations, expired or missing licenses, failing hardware and dependencies on third-party services. Unless an Agreement says otherwise:
- Tekem is not responsible for conditions that existed before our work began, or that were concealed, undisclosed or not reasonably discoverable during scoping.
- Addressing such conditions may require a change request with adjusted fees and schedule.
- You are responsible for maintaining current backups of your systems and data before and during any engagement.
7. Third-party materials and manufacturer warranties
We may recommend, configure, integrate or resell software, cloud services, hardware and other products made by third parties, and the Website may contain third-party content or links. Those products and materials are governed by their own license terms, warranties and privacy policies. Tekem does not make any separate warranty for third-party products and is not responsible for their performance, availability, security incidents, outages, changes or end of support. Where permitted, we will pass manufacturer and vendor warranties through to you, and your remedies for third-party products are limited to those warranties.
8. Job listings and placement
Job listings are provided for information and may change, be filled or be withdrawn at any time. Applying does not guarantee an interview, placement or employment, and listed details such as level, workplace and requirements are summaries that may differ from the final role. Employment decisions are made by the hiring employer. Tekem never asks candidates for payment to apply or be placed.
9. Testimonials, examples and imagery
Testimonials and examples on the Website reflect individual experiences and are not a guarantee of similar results. Results depend on each organization’s circumstances. Some photographs on the Website are illustrative and do not depict actual Tekem staff, clients, candidates or offices.
10. External links
Links to third-party websites are provided for convenience. We do not control or endorse those websites and are not responsible for their content, products, services or privacy practices.
11. Errors and changes
We try to keep the Website accurate, but it may contain errors, omissions or outdated information. We may correct, change or remove content at any time without notice. We may also update these Disclaimers by posting a new version with a new “Last updated” date.
